Malpractice and Maladministration Policy 

Aim of Malpractice and Maladministration Policy

The aim of this policy is to protect the interests of WSET students and safeguard the integrity of WSET qualifications by ensuring compliance with WSET Policies and Procedures. It provides a framework for the identification, reporting and management of any potential malpractice or maladministration and for the application of sanctions. 

Definition of Malpractice and Maladministration

Non-compliance with WSET Policies and Procedures generally falls into one of two categories: 

  1. Maladministration, where non-compliance is accidental rather than intentional; and 
  2. Malpractice where non-compliance is intentional or the result of negligence. 

The boundaries between maladministration and malpractice are not clear-cut. Some incidents may fall into either category depending on the wider context. Some maladministration incidents may become malpractice e.g. through failure to implement corrective measures, repetition of the incident, or subsequent attempt at non- disclosure or misrepresentation. A malpractice incident may be deemed to be maladministration if there are extenuating circumstances. Whether a situation is maladministration or malpractice will be determined by WSET following an investigation. 

Scope of Malpractice and Maladministration

Malpractice or maladministration may include: 

  • Failure to adhere to the terms of Centre Agreement or WSET Policies and Procedures; 
  • Failure to carry out course or assessment delivery in accordance with WSET requirements; 
  • Failure to adhere to WSET’s candidate registration and certification procedures; 
  • Withholding of information from WSET which is critical to maintaining the rigour of quality assurance; 
  • Insecure storage of assessment materials; 
  • Cheating, including the use of unauthorised devices or materials; 
  • Disruptive behaviour in an exam; 
  • Impersonation (including forgery of signatures); 
  • Breach of confidentiality; 
  • Failure to a disclose Conflict of Interest; 
  • Issue of incorrect exam results/failure to issue results to students in a timely manner; 
  • Unauthorised reading/amendment/copying/distribution of exam papers; 
  • Failure to report changes in ownership/personnel/location/facilities; 
  • Denial of access to information, documentation, workforce, facilities; 
  • Failure to respond to WSET in a timely manner; 
  • Failure to return exam papers within the specified timeframe or to follow delivery and tracking regulations; 
  • Infringement of WSET copyright, trademarks, intellectual property rights and brand identity; 
  • Use of unqualified and/or unregistered educators or internal assessors; 
  • Misleading advertising/publicity.  

Responsibilities

Seoul School of Wine should ensure compliance with WSET Policies and Procedures. Any non-compliance will be immediately notified to WSET Quality Assurance team. If the non-compliance incident occurs during a WSET exam, the Exams Officer must notify WSET by submitting the Notification of Malpractice Form (available on the Global Campus). All other notifications should be submitted in writing (email is accepted) and should include: 

    • A detailed account of the circumstances surrounding the suspicions and allegations; 
    • Details of any consequent actions or investigations carried out by the centre; 
    • Any extenuating circumstances (e.g. medical reports); 
    • Details of any procedures followed for informing staff/students of consequences of malpractice and maladministration; 
    • Any unauthorised materials found during assessment; 
    • Written statements signed and dated by any individuals.


Management of non-compliance 
If APP actions/maladministration leads being disadvantaged, APP should also refer the student to Complaints Policy.

Sanctions applicable to Students/Candidates may include written warning, exam result declared null and void, disqualification, etc.

행정 과실  부실 정책의 목표

 정책의 목표는 WSET 정책  절차를 준수함으로써 WSET 학생의 이익을 보호하고 WSET 자격의 무결성을 보호하는 것입니다이는 잠재적인 부정 행위 또는 잘못된 관리를 식별보고  관리하고 제재를 적용하기 위한 프레임워크를 제공합니다.

행정 과실  관리부실의 정의

WSET 정책  절차를 준수하지 않는 것은 일반적으로 다음  범주  하나에 속합니다.

불이행이 고의가 아니라 우발적인 경우 관리 부실그리고

규정을 준수하지 않는 것이 의도적이거나 태만의 결과인 과실.

행정상 과실과 업무상 과실 사이의 경계는 명확하지 않습니다일부 사건은  넓은 맥락에 따라  범주  하나에 속할  있습니다일부 관리 불량 사건은 행정 과실이   있습니다시정 조치를 이행하지 않거나사건이 반복되거나이후의 비공개 또는 허위 진술 시도를 통해정상 참작이 가능한 경우 업무상 과실 사건은 행정상 과실로 간주될  있습니다조사  WSET에서 상황이 관리 부실인지 행정 과실인지 여부를 결정합니다.


행정 과실  관리부실의 범위

행정 과실 또는 관리 불량에는 다음이 포함될  있습니다.

센터 계약 또는 WSET 정책  절차의 조건을 준수하지 않는 경우

WSET 요구 사항에 따라 과정 또는 평가 제공을 수행하지 못한 경우

WSET 후보자 등록  인증 절차를 준수하지 않는 경우

엄격한 품질 보증을 유지하는  중요한 WSET 정보 보류

평가 자료의 안전하지 않은 보관;

승인되지 않은 장치 또는 자료의 사용을 포함한 부정 행위

시험에서 방해가 되는 행동;

사칭(서명 위조 포함)

기밀 위반

공개하지 않은 이해 상충;

부정확한 시험 결과 발급/적시에 학생들에게 결과를 발급하지 못함;

시험지의 무단 열람/수정/복사/배포,

소유권/인력/위치/시설의 변경 사항을 보고하지 않은 경우

정보문서인력시설에 대한 액세스 거부

적시에 WSET 응답하지 못한 경우

지정된 기간 내에 시험지를 반환하지 않거나 배송  추적 규정을 따르지 않는 경우

WSET 저작권상표지적 재산권  브랜드 아이덴티티 침해

무자격 /또는 미등록 교육자 또는 내부 평가자의 사용;

오해의 소지가 있는 광고/홍보.


책임

서울와인학교는 WSET 정책  절차를 준수해야 합니다모든 비준수 사항은 즉시 WSET 품질 보증 팀에 통보됩니다. WSET 시험 중에 규정 위반 사건이 발생하면 시험 담당관은 위반 통지 양식(글로벌 캠퍼스에서 제공) 제출하여 WSET 알려야 합니다기타 모든 통지는 서면으로 제출해야 하며(이메일 허용다음을 포함해야 합니다.

의심  혐의를 둘러싼 상황에 대한 자세한 설명

센터에서 수행한 후속 조치 또는 조사에 대한 세부 정보

참작할  있는 상황(:   보고서)

개인이 서명하고 날짜를 기입한 서면 진술서.

비준수 관리 APP 조치/부적절한 관리로 인해 불이익이 발생하는 경우 APP 학생을 불만 정책으로 안내해야 합니다.

학생/후보자에게 적용되는 제재에는 서면 경고무효로 선언된 시험 결과실격 등이 포함될  있습니다.
